A legal expert said Biden's team appears to have done "exactly what you're supposed to do."
A US attorney is reviewing a handful of classified documents found at President Joe Biden's former office in Washington, CBS News reported Monday. In a statement, Richard Sauber, special counsel to President Biden, said the White House is cooperating with the National Archives and the Justice Department on the matter. "The documents were discovered when the president's personal attorneys were packing files housed in a locked closet to prepare to vacate office space at the Penn Biden Center in Washington, DC," Sauber said. Biden held a position at the center, run by the University of Pennsylvania, from 2017 to 2019. The documents "were not the subject of any previous request or inquiry by the Archives," Sauber noted and were immediately handed over to the record-keeping agency. The Washington Post on Monday evening reported that roughly 10 documents were found at the Penn Biden Center for Diplomacy and Engagement, citing a person familiar with the probe. The White House Counsel's Office notified the archives upon the discovery and the agency quickly took control of the records, Sauber told the outlet. The documents were found shortly before Attorney general Merrick Garland named former federal prosecutor Jack Smith as special counsel to oversee two Trump-related investigations in mid-November. Former President Donald Trump immediately pounced on the story. "When is the FBI going to raid the many homes of Joe Biden, perhaps even the White House?" he posted on his social media network. But Bradley P. Moss, a national security lawyer, told Insider that so far this looks like a routine matter with no allegation of criminal wrongdoing. He contrasted what we know about the case with that being built against Trump, who held boxes of classified documents at his Mar-a-Lago resort even after their return had been demanded by the National Archives. "Biden's team did exactly what you're supposed to do," Moss said. "When you find improperly stored classified documents, you immediately notify the government - and you turn it over immediately." Classified documents are routinely misplaced, and so far this looks to be a routine investigation, perhaps motivated in part by a desire by the Department of Justice to show it is impartial, Moss said. The nature of the investigation would change if the US attorney in charge of reviewing the documents, Matt Lausch, a Trump appointee, were to uncover any evidence that Biden or his staff misled the National Archives. "The reason Donald Trump is in criminal jeopardy right now isn't just because of the documents being improperly stored. It was the obstruction," Moss said. From the reports I've seen, the lawyers for Biden found the documents, and IMMEDIATELY called (in less than 24 hrs) the appropriate authority to come pick them up... and Biden's people handed the documents over... which is what is supposed to happen when improperly placed classified material is found.

Attorney General Merrick Garland will likely need to put away his dreams of prosecuting Donald Trump over taking presidential documents when he left the White House By Gregg Jarrett Scratch another undoable item off Attorney General Merrick Garland's bucket list. He can forget prosecuting former President Donald Trump for taking presidential records with him when he departed the White House. It turns out the attorney general's boss, Joe Biden, did the same thing when he left the Obama administration. Glaring hypocrisy aside, it would be difficult to justify criminally charging one president while turning a blind eye to the other. Legally, it would boomerang. Politically, it would be poisonous. Monday's revelation that classified documents were found in a private office previously used by Biden blew a cannon hole in any potential case against Trump. If Garland is foolish enough to proceed anyway, the former president could assert selective prosecution as an affirmative defense. No one else has had his home raided by the FBI or faced criminal indictment. But more broadly, Trump's lawyers would argue that the plague of wayward documents is a common occurrence during hasty presidential transitions. Outgoing presidents don't personally pack up their own papers and belongings. The General Services Administration (GSA) pursuant to federal law performs this duty. Sorting millions of files in a short time frame is a recipe for mistakes, especially where personal papers have been commingled with official records. It is a staggering undertaking. As I pointed out in a column last summer, during the last 60 years materials have been erroneously categorized and/or misplaced in nearly every administration. Transfers rarely run smoothly. That doesn't mean a crime occurred, even where classified records end up in the wrong place. Disagreements over custody can be protracted but are usually resolved amicably. So much of Garland's case against Trump has been predicated on the allegedly classified nature of the documents found at Mar-a-Lago. But at its core, that's an assumption that has not yet been litigated. Trump insists he declassified them before he departed office. If true, then this is little more than a dispute over custody of materials under the Presidential Records Act of 1978, which is civil and not criminal. The Act grants former presidents a right of access to presidential papers, as well as possession. It serves as the controlling statute, rendering the criminal laws cited by Garland in his search warrant irrelevant. The proper remedy was for the attorney general to file a motion to compel enforcement of the original civil subpoena seeking records. Let an impartial judge resolve the conflict. Instead, Garland chose to ignore the language of the Presidential Records Act and raid Trump's home under the guise of criminal codes that have no application. He snookered a magistrate into signing an overly broad general search warrant that is strictly prohibited by the Fourth Amendment. In addition to the imbroglio over classified records, Garland's warrant accused Trump of obstructing justice because he wasn't as compliant as the FBI demanded. This is an exaggerated, if not silly, claim. One can bicker over whether Trump was fully cooperative or promptly forthcoming. But he was entitled to resist under the legal standard set by the Department of Justice a decade ago in a similar case involving former president Bill Clinton. At the time, the DOJ adopted the position that a former president can keep whatever presidential records he wants and the government has no authority to seize them. This was a conclusion shared by the National Archives and a U.S. District Court in Washington, D.C. As a result, Clinton was allowed to maintain possession of audiotapes that allegedly contained classified information. Ten years later, the established "Clinton standard" suddenly vanished overnight because the person in question was named Trump. The case comparison shows that Garland defied both the Justice Department's own legal interpretation of the law and previous court precedent to target Trump. The AG's flagrant abuse of power bears the unmistakable stench of partisan politics, which has infected the attorney general's corrupt tenure from the outset. The news that Biden did the same thing as Trump was met with palpable chagrin in the mainstream media. Their dreams of Trump in an orange jumpsuit suddenly dissolved. Immediately, anchors and pundits alike downplayed the news, invented excuses for Biden, and strained at the belly to persuade their audiences that the two cases were materially different. They are not. The most laughable effort came - predictably - from The New York Times. Their disingenuous coverage amounted to a presidential apology. While defending Biden for an innocuous mistake, the newspaper tried in vain to draw a distinction in the Trump matter. "In any case," the reporters wrote, "the potential charges the FBI cited in the search warrant affidavit do not depend on whether intentionally mishandled documents were classified." What? Sure they do. Did the reporters read the warrant? Better yet, did they even read their own story published five months earlier? The front-page headline in the Times on August 13 thread, "Files Seized From Trump Are Part Of Espionage Act Inquiry." Citing the warrant, the first two sentences explained how the FBI was focused on the mishandling of classified document under the Espionage Act. Two of the three reporters in the byline were the same ones who penned the most recent apologia. Either their memories are short or they are members of Biden's public relations team peddling dishonest accounts. It should surprise no one that Biden and Garland concealed the disclosure of his classified documents from the public and congress for two long months. The material was uncovered on November 2, 2022, just as the attorney general was preparing to appoint a special counsel to investigate Trump. Covering up Biden's mess conveniently avoided a negative story for Democrats in advance of the midterm elections. Democrats downplay Biden classified docs debacleVideo There is an obvious pattern here. It is reminiscent of how the Biden White House and the FBI pressured social media platforms like Twitter to suppress and censor the Hunter Biden laptop story in the weeks before the 2020 presidential election. Burying it likely helped Biden prevail over Trump. The president could not maintain his cloak of silence any longer. He was forced to come clean on Monday because Republicans regained control of the House, installed a Speaker over the weekend, and are about to launch a series of nettlesome investigations that would have lifted the veil of secrecy protecting his own classified documents scandal. Last summer, Biden publicly castigated Trump as "totally irresponsible" for keeping classified documents at his Florida residence. It was a political cheap shot, to be sure. Biden's team proactively searched for and returned classified documents that were most likely taken accidentally. Trump kept thousands of government records, hundreds of which were marked as classified, inside his personal residence in Florida for more than a year after departing the White House, and did not return them immediately or willingly despite numerous requests by the National Archives. When he finally handed over 15 boxes of records in January 2022, the Archives discovered more than 100 marked as classified. It referred the matter to the Justice Department in the spring and a special counsel, Jack Smith, was named in November to oversee the investigation. Investigators tried to get Trump to return any remaining classified records through a grand jury subpoena and a visit to Trump's Mar-a-Lago estate in Palm Beach, Florida. On that visit, Trump's advisers returned a few dozen additional classified records, and attested that no other classified material remained in the residence. Suspecting possible obstruction of justice, the FBI sought and obtained court approval in August to search his home, where agents found more than 13,000 additional records, about 100 of them classified. |

I wanted to clarify the alleged timing of the various finds. As we have already reported there was the cache that was found at the Penn Biden Center, locked in a closet by the personal attorney who just happened to be clearing out Biden's old office. Then there was a second set that we reported on earlier, which was found in his garage, near his Corvette. That's the one that Biden commented on and said they were safe because they were kept in the locked garage near his Corvette. He got decimated by George Washington law school professor Jonathan Turley, who mocked his claim of a "Corvette Standard," noting that wasn't a viable excuse. A campaign video also showed how insecure that garage truly looked. That second set was supposedly found on December 20. Now, we mentioned another document found in the Biden residence in Wilmington. That's a "third find" - that wasn't found on December 20. That supposedly was just found, and the DOJ was just notified about it, on Jan. 12. So now, not only did they cover up the November find before the election, but when they first told us about that on Monday, they didn't even mention the second set of documents found in the garage, which they already knew about. On top of this, Attorney General Merrick Garland said he had appointed a U.S. Attorney to look into this on Nov. 10. So, why weren't we told about that back in November? This is a festival of lying and cover-up, imploding right in front of us. Prof. Turley raises a great point at this juncture, given what a mess this is: why are Biden's private attorneys still allowed to root through everything? Shouldn't there be the FBI at their side at this point, to make sure that things aren't being destroyed/covered up? Turley also notes that not only were they kept in unsecured locations, but they have probably moved around to more than one place. Not to mention, all the people who may have had access to them in the house, the garage, and at the Penn Biden Center, and wherever else the documents may have been since Biden wrongly removed them years ago. We're also saying "six years" since he left being vice president. But these documents may not have been removed at the end of his time as VP; they could have been taken over all the time he was in office as VP. So, it could have been longer than six years. Levin next pointed to the differences between where both sets of classified docs were stored. 2. The documents Trump had were protected in a location guarded by the secret service. Not so with Biden. And this is a big one - which is "shockingly" ignored by the Biden White House and lapdog media: 3. Another difference is that Trump was president and had the indisputable constitutional authority to classify and declassify information as he saw fit. Biden, as vice president, had no such power. 'There were absolutely no additional measures to safeguard and protect the information,' says one expert of Biden's storage of classified materials Kyle Morris , Ashley Papa Security experts are sounding off about President Biden's handling of classified materials, suggesting that the documents could have been more susceptible to leaks than those found in former President Donald Trump's Mar-a-Lago estate last year. Under scrutiny from Republicans, Attorney General Merrick Garland appointed a special counsel Thursday to investigate the classified materials, which Biden claims were "inadvertently misplaced." The Justice Department escalated it to a special counsel investigation from a mere review after a second stash of classified documents was found inside the garage of Biden's Wilmington, Delaware, home. The first documents were found inside the Washington, D.C., offices of the Penn Biden Center think tank. Garland tapped Robert Hur, a former U.S. attorney, to handle the investigation. Charles Marino, the CEO of Sentinel Security and a former Homeland Security Department advisor who specializes in law enforcement, told Fox News Digital that Biden's handling of the documents, compared to Trump's, could have resulted in greater potential for "leakage." "The storage of classified documents was not authorized at any of these locations, however there are several distinctions with respect to the potential 'leakage' of the information contained within the documents via controls that would have likely prevented or limited unauthorized access to the locations," Marino said. Noting that Trump "had the power to declassify whereas Joe Biden as vice president did not," Marino suggested that Trump's additional Secret Service protection granted the documents slightly more protection. "Former Presidents continue to receive Secret Service protection and deploy security technologies, whereas former Vice Presidents do not, beyond an initial six-month extension. This means there was no US government provided security at the residence in Wilmington, Delaware, or at the Biden-UPenn think tank office in Washington, D.C. for close to six years," he said. "Former Presidents are eligible to continue to receive both secure communications and facilities. For example, former Presidents are eligible to request continuation of receiving the classified presidential daily briefings. Former Vice Presidents are not." Biden's claim that he was unaware he possessed classified materials, according to Marino, also a former Secret Service special agent, adds to concern over how closely the documents at both locations were protected. "Not knowing that one is in possession of classified documents, as Biden has claimed, means that there were absolutely no additional measures to safeguard and protect the information," he said. "Former President Trump acknowledged such possession, took steps to secure them in one location (although still not in accordance with storage requirements for classified info), and is still granted additional security resources for deterrence and detection." Special counsel to the president Richard Sauber disclosed in a statement Saturday that five additional pages of documents with classified markings were found at Biden's Delaware home Thursday evening, making a total of six classified documents retrieved from the house - in addition to the documents discovered in the garage. Sauber explained that when Biden's personal attorneys identified one classified document at Biden's home on Wednesday, they stopped searching for additional documents, because they lacked the security clearances necessary to view those materials. The first batch of classified documents in Biden's possession was found at the Penn Biden Center on Nov. 2, just before the 2022 midterm elections, and not revealed until Monday. A search of Biden's garage at his Wilmington home was conducted on Dec. 20, and the remainder of the house, according to Biden's lawyers, was searched this week, when additional documents were discovered. Woke NBA Star Steph Curry Wants to Block Low-Income Housing in His Neighborhood
By Bob Hoge | 4:45 PM on January 31, 2023 I'm not thrilled to be writing this article, because Golden State Warriors basketball star Steph Curry has long been one of my favorite players to watch, and I loved going along for the ride as the Dubs climbed to the top of the NBA world to win four championships - so far. I tried to ignore coach Steve Kerr's incessant woke lecturing as he turned every postgame interview into a political rant, but I finally lost my joy in watching the team when they on two occasions refused to visit the White House for a victory party because Donald Trump was president. Then George Floyd was killed, the country went up in flames in BLM riots, and the NBA went full-on woke and became more of social justice advocacy group than a sports league. But as is so often the case, "woke is for thee, not for me," and Curry is now opposing low-income housing in his neighborhood of Atherton, California - home of the priciest real estate in the nation. In a letter to local officials, Steph and his wife Ayesha wrote: "We hesitate to add to the 'not in our backyard' (literally) rhetoric, but we wanted to send a note before today's meeting. Safety and privacy for us and our kids continues to be our top priority and one of the biggest reasons we chose Atherton as home." See the full letter: One line in the letter jumps out at me: We kindly ask that the Town adopts the new Housing Element without the inclusion of 23 Oakwood. Notice he's not saying the Housing Element - a zoning plan that aims to increase housing availability (read: increase density) - is bad for non-urban, family neighborhoods; he's saying it's just fine as long as it doesn't apply to him. It's a pretty hypocritical stance for the avowed Biden supporter, who brought his family out to endorse Joe for president at the 2020 Democratic National Convention. His wife Ayesha regularly speaks about "social injustices" and "racial inequality." Just not in her backyard: Curry goes on to say that if his effort to stop the low-income housing were to fail, the town should pony up to block the atrocity from his view: "Should that not be sufficient for the state, we ask that the town commits to investing in considerably taller fencing and landscaping to block sight lines onto our family's property." Curry signed a four-year, $215 million contract with the Warriors in 2021, and is slated to make a cool $48 this season - in addition to his lucrative endorsement deals. Surely he could afford a little landscaping? I can understand Curry's not wanting high-density, low-income apartments built right next to him, and his desire for privacy and safety, but a lot of people feel that way. Steph doesn't seem too concerned about them. I'm not a fan of these urbanization plans for family suburban neighborhoods - but I didn't vote for the kind of folks who advocate for them. You can bet that Curry did.
