Ironically, he's losing in the court of public opinion too. I don't think his closed eyed "meditations" are making him any friends on the jury either. At the close of the prosecutors' case, the judge will conduct a plea colloquy where place trump under oath and question him about his right to testify and his right to remain silent. It cannot be anyone's decision but Trump's own and the judge will get that decision on the record. This happens in every criminal trial to every criminal defendant. There will be no confusion as to what Trump decides. He will not testify. This means that he cannot establish what he was thinking or intending affirmatively. He would have to testify for that and subject himself to cross examination for that. He cannot play dumb quietly or loudly. That's the problem with this charge for him.
