GOP-led Michigan Senate investigation finds no evidence of election fraud

An investigation by Michigan's Republican-led Senate Oversight Committee found no evidence of widespread voter fraud in 2020, and recommended that Michigan's attorney general investigate individuals who made false claims "for their own ends."

Why it matters: A 35-page report released by the committee debunks election falsehoods and conspiracy theories spread by former President Trump and his supporters in the aftermath of November's election.

As recently as May, Trump was falsely claiming that votes in Michigan were "intentionally switched" from him to President Biden, calling the fraud allegation "MASSIVE and determinative."

Driving the news: The months-long investigation repudiates claims from GOP activists who alleged that some voting machines were "manipulated" in rural Antrim County, where human error by the Republican clerk led to initially skewed results, per Bridge Michigan.

"The committee finds those promoting Antrim County as the prime evidence of a nationwide conspiracy to steal the election place all other statements and actions they make in a position of zero credibility," the report says.

The report acknowledges that "there are glaring issues that must be addressed in current Michigan election law, election security, and certain procedures," but says the issues should not bring into question the integrity of the 2020 election.

What they're saying: "Our clear finding is that citizens should be confident the results represent the true results of the ballots cast by the people of Michigan," the report concluded.

"The committee strongly recommends citizens use a critical eye and ear toward those who have pushed demonstrably false theories for their own personal gain."

"The committee recommends the attorney general consider investigating those who have been utilizing misleading and false information about Antrim County to raise money or publicity for their own ends."

LANSING, MI - A Republican lawmaker wants to create a bipartisan board to contract with an "impartial, nonpartisan corporation" to audit the 2020 election.

Despite the Michigan Secretary of State's conclusion that no fraud or foul play occurred during the 2020 election following its post-election audit in March, state House Rep. Steve Carra, R-Three Rivers, is calling for an independent review that he says would help identify how to make elections "secure and accessible for every Michigan voter."

Carra on Tuesday introduced House Bill 5091, which would create a bipartisan audit board to review the 2020 general election. Despite court rulings, canvassing boards and dozens of audits performed across the state affirming the results, Carra said in an interview Tuesday that the only way to ensure the integrity of the 2020 election is through what he calls a "forensic audit."

"It's just an investigation putting in-depth scrutiny and review to the process. The, quote, 'audits,' that she's done are just little baby recounts done internally and not done by an independent nonpartisan process," Carra said when asked of the procedures involved in a forensic audit.

Carra questioned the integrity of the dozens of audits already completed by the Michigan Secretary of State, saying they did not go far enough.

Secretary of State Jocelyn Benson took to social media last week to push back against calls for a forensic audit that have been gaining momentum among conservative activists.

"A forensic audit is not a thing," Benson said in a Twitter post.

Under House Bill 5091, a bipartisan audit board would be tasked with contracting an outside group to conduct the investigation of the 2020 general election. The audit would be required to begin no later than 45 days after the bill takes effect, and the corporation would have 90 days to complete the audit. The bipartisan audit board would then have two weeks to complete and submit a final report.

The bill proposes a body that would consist of seven members: the state auditor general or the auditor general's designee; one each appointed by the Republican and Democratic leaders of the House and Senate; and one election challenger who served during the 2020 general election from each of the two major political parties.

Carra's bill asks auditors to take a look at 10% of precincts from across Michigan's counties and 20% from "each city with at least 500,000 residents," a designation that only the city of Detroit would qualify for.

"Wayne County has, I believe, 999 precincts, so, you're looking at roughly 100 precincts being reviewed in Wayne County, but additional for Detroit because there was so many questions in the city of Detroit, so many of their precincts were out of balance and there are just questions in general," Carra said.

An unbalanced precinct is when the number of ballots cast is unequal to the number of voters recorded in a precinct's poll book. The November election isn't the first time out-of-balance precincts have raised concerns, as Michigan election law doesn't allow recounts of precincts where poll books don't match the number of ballots cast.

Out-of-balance precincts "could potentially" indicate election fraud, Carra said in an interview Tuesday.

Election officials say precinct imbalances are typically an indicator of human error, such as a jammed tabulator or a person signing in to vote and leaving before casting their ballot.

Included in Carra's proposal are solutions to issues that have been circulating among election conspiracists for months.

Under his bill, auditors would be asked to check to make sure whether electronic poll books were "connected to a network," as well as to analyze electronic voting systems to determine whether ballots were cast by humans or machines. The audit would also log the ways in which Michigan voters cast their ballots in 2020.

"We need to look into qualified voter files, see if there's any anomalies. We need to look into what machines may or may not have been connected to the internet, we need to look into this system, which I would contend is very ripe for fraud," Carra said.

The bill signals to many Trump supporters in Michigan who for months have claimed, without evidence, the election was rigged in favor of President Joe Biden that another comprehensive look into the 2020 election is being considered.

Last week, Carra joined a few hundred people outside the state Capitol for an event that propelled conspiracy theories about the 2020 election, where activists demanded "a complete audit of the statewide election results and all votes, machines and software."

"They want to see that we verify the election results," Carra said. "I don't know a single person who was there Thursday or a single person in my community who I've talked to who wants to overturn the election, they all want to verify the results and whoever got the most votes should be recognized."

In Arizona, an election audit led by the state's Republican-led Senate has hired a cybersecurity firm called Cyber Ninjas to conduct its own audit after other elections found no fraud. Carra didn't indicate a specific corporation he had in mind to perform his audit, but said that it's impossible for people to trust the Michigan Secretary of State.

Benson argues partisan groups pushing for an audit shouldn't have access to secure election materials. She has called the Arizona audit an illegitimate effort to spread misinformation and undermine faith in elections.

HB 5091 was formally read on the House floor Tuesday and was referred to the Government Operations Committee.

Heard that the rep'n run MI government is ramming through a new set of anti voting laws - in response to a report that clearly says that there was no fraud.. WTF.... but not surprising.. sounds like a good appeal case for SCOTUS..

Former President Donald Trump labeled the Michigan state Senate's election investigation that confirmed President Joe Biden's victory a "cover up" Thursday.

Trump, who acknowledged Monday that he hasn't conceded the November race, ridiculed the state Senate Oversight Committee's investigation, the results of which were announced a day before.

He called out Mike Shirkey, the majority leader of the state Senate, and Ed McBroom, the head of the committee, claiming they are "doing everything possible to stop Voter Audits in order to hide the truth about" the election. Trump also urged supporters in Michigan to "vote them the hell out of office" if they don't "do the right thing."

"The Senate 'investigation' of the election is a cover up, and a method of getting out of a Forensic Audit for the examination of the Presidential contest," he said. "Corrupt (?) politicians falsely claim there was no Voter Fraud in Michigan (has anyone looked at what is considered the most corrupt election city in the U.S., DETROIT?)."
