He definitely deserves time in jail. Hope he gets plenty!
I just can't think of a reason for the lawsuit against Chrysler.

The BIG BUCKS.... that's what lawyers & law suits
are all about. Billy did a bad thing & lawyers are
bad for society. It's simply too late to rid the world
of the vermin....

Wrong! The level is set by law and is not open to arbitration. "Impaired" means exactly that: Impaired. Not "slightly impaired," or somewhat impaired but still capable." And if the law proscribes the minimum acceptable alcohol content (level) as .08, so be it, end of discussion.

The dictionary defines "arbitrary" as follows:

1. subject to individual will or judgment without restriction; contingent solely upon one's discretion: an arbitrary decision.
2. decided by a judge or arbiter rather than by a law or statute.
3. having unlimited power; uncontrolled or unrestricted by law; despotic; tyrannical: an arbitrary government.
4. capricious; unreasonable; unsupported: an arbitrary demand for payment.
5. Mathematics: undetermined; not assigned a specific value: an arbitrary constant.

The previous blood alcohol content (BAC) was set at 1.0% (one percent). It was amended to to .08% (eight-tenths of one percent). There is nothing arbitrary about this fact: .07% is legal, .08% and higher is not.

You may be able to function perfectly well with a higher blood alcohol level than the person next to you can, but the law applies across-the-board to the widest range of people. Depending on how one's body absorbs and dispels the BAC, one person may be impaired after two beers (or the equivalent), while someone else isn't. Regardless, if your BAC measures .08%, you are ---according to a very specific law--- unable to legally operate a motor vehicle.

Sounds like me it's a bullsshit case they have against Chrysler. They oughta lose. (unless there is something else besides what they said(like the owner of chrysler actually giving the guy alcohol and forcing him to drive against his will))

Billy paid his due. No excuses, but debt to society paid.
If tahoe's still around, his argument as ..08 BAC as unarbitrary is illogical by his own description. Some are "impaired" to drive by .02 BAC while some are not impaired to drive at a significantly higher BAC. Hence .08 is is an arbitrary figure.
