Well I never thought I'd end up being in this situation, but what do you do when you end up with a terrible neighbor. I have been a paying tenant at the same residence for a long-time now and have recently had new neighbors move in who within the first 3 months, have decided to call the police about a noise a complaint and the city about my residence being in non-compliance for multiple things. The short story is that, I'm just getting tired of dealing with deputies and inspectors make you feel as if you're getting interrogated every time. I called to ask a general question and got an interrogation, "what is your name, dob, phone, address". What does that have to do with asking about how to deal with a neighbor?
On a legal side note, 1. Are you allowed to ask a deputy to not be on your property? 2. Are you required to provide answers...how far does the right to remain silent go? 3. If you say, you would like to go in your house and avoid questioning or be left alone and do not wish to provide any information including identification can you legally be detained? 4. Can you request to limit the number of police officers in your proximity, in regards to feeling harassed or anxiety? (Unless it's a routine traffic stop, every Cape Canaveral encounter I've had has been 3-5 officers, literally just hanging out waiting... I'm sorry if I don't want to be your friend officer, but I'd rather not talk to you about my new surfboard or beat up camper after you've just tried to ticket me.
Has anyone else dealt with the crappy neighbors or unpleasant police officers before? How about just constant police presence? I don't think its normal to see 2-3 cop cars cruising down the street you live on everyday. (We live at the beach not the ghetto)

You are just setting yourself up for more issues...old man sage advise "Kill them with Kindness"...It really works!! Good luck! In all fairness, it is hard to tell given how vague you were about what was upsetting the neighbors. I mean if you were overtly loud outside of what is allowed by county ordinance, then you are the one being the asshole for disturbing your neighbor.
Noise Ordinance If your property is unkempt and an eye sore in violation of code, dangerous, over grown.... then once again, you are the one being the asshole. If none of that was happening and the neighbor was just being a douche, then you might eventually have a harassment claim. |

I am confused by who the a-hole is in this situation. Hahah good one Miker!! Isnt there a lawyer in NSR, summon him and you will find out who the A-hole is! To be honest I have politely told the police I have plans, or am busy so if I am not being detained I would like to go about my business.... Usually the nice just chatty bored ones will snap out of it and say ok sure sorry later! ------------------------- I troll 2L.com to be a better person in real life |

I'm just going to guess at the answers. No expert, no lawyer. Just throwing it out there.
1) I believe they have the right to come up to your front door and knock. Unless a crime is committed can't come inside without permission. but, yes, can be on your property. 2) I would think just showing identification is all. However, if you clam up they are going to suspect something. 3) Tough one. I would say yes, unless they arrest you with a crime they can't keep you from going inside. If they are at your house by a complaint I would say you would have to comply with what they say. Don't know though. 4) I would think no. But, I have no idea. Police officer is a tough job. Dealing with a-holes all day long. Day in and Day out. Probably best just to treat them with respect. Good luck. |

@miker. It's new neighbors from an HOA, they even called my landlord. Keep in mind I've lived there for 2 years with not one complaint. The noise complaint was at 2pm in the afternoon. The tenants from the apartment complex directly across the street from their new house have been yelling and playing lynyrd skynyrd loud at 11pm at night since I can remember. All they can do is knock - in order to come inside uninvited a warrant is needed!
Answering questions is best to do if you've got nothing to hide, but you don't have to do it! you'll get a lot further with being civil / professional... kinda like stokedpanda explained!

Sounds like you may live in Cape Canaveral, which may be part of the problem. Cape Canaveral is the beachside-butthole of Brevard County. Drive around Cape Canaveral in the middle of the day on a weekday and all you see are feral cats and toothless, banged-up, people, dragging a leg around town, and looking for more crack or meth. Looks like a scene out of The Walking Dead every single day.
Telling a cop that you can't have more than 2 of them on your property at any given time makes you have an anxiety attack sounds like a fantastic recipe for harassment. Sounds like you are looking to make things worse on yourself than they already are every way you can.
